General Terms of Service

Welcome to TOL LLC (“Company”, “we”, “our”, “us”). By accessing or using the tolllc.com website (the “Site”), you agree to be bound by these General Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site.
2. Scope of Terms and Product-Specific Agreements
TOL LLC operates as the parent company and developer for various software applications and services, including but not limited to TabLock, Call Isabel, and Context Handoff.
These General Terms govern your use of the corporate Site. However, our individual products and services are governed by their own specific Terms of Service, End User License Agreements (EULAs), and Privacy Policies. In the event of a conflict between these General Terms and the terms specific to a particular product or service, the product-specific terms will supersede and govern.
3. Intellectual Property Rights
All content, design, graphics, compilation, magnetic translation, digital conversion, and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use, or publication by you of any such matters or any part of the Site, except as allowed by Section 4, is strictly prohibited. You do not acquire ownership rights to any article, document, or other materials viewed through the Site.
4. Limited License; Permitted Uses
You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site, you warrant to TOL LLC that you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

IN NO EVENT SHALL TOL LLC, ITS MANAGING MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SITE OR ANY CONTENT PROVIDED ON OR THROUGH THE SITE.
7. Governing Law and Jurisdiction
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal action or proceeding related to this Site shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Massachusetts.
